Terms of service

These Terms of Service (the “Terms”) govern your access to and use of dnaPower Inc. products, testing services, websites, online store, customer portal, personalized reports, consultations, and related services (collectively, the “Services”). By accessing the website, placing an order, creating an account, registering or using a testing kit, submitting a biological sample, accessing a report, or otherwise using the Services, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, do not access or use the Services. Our Privacy Policy and Return and Refund Policy form part of these Terms and should be reviewed together with them.

1.  Eligibility and Authority to Consent

You must be at least 18 years old to purchase dnaPower testing services for yourself. If you purchase, register, or submit a sample for a minor or another person, you confirm that you are the person’s parent, legal guardian, or otherwise legally authorized to provide consent on that person’s behalf.

By submitting a biological sample, you confirm that the sample belongs to you or to a person for whom you are legally authorized to provide consent.

2.  Testing Services and Reports

dnaPower provides testing services designed to deliver personalized wellness information based on the biological sample and information submitted. Depending on the service purchased, testing may involve genetic, microbiome, pharmacogenetic, epigenetic, or other test-related analysis.

Following laboratory analysis, you may receive a personalized report through the dnaPower customer portal or another method identified by dnaPower. Reports reflect the service purchased and the scientific information, analytical methods, and laboratory processes available at the time of testing.

3.  Customer Consent

By ordering, registering, or using a testing service, you voluntarily consent to dnaPower and its authorized laboratory and service partners collecting, processing, and analyzing your sample and related information as necessary to provide the service you selected.

You understand that results may contain information that is unexpected, sensitive, incomplete, or of uncertain significance. You also confirm that information you provide is accurate and complete to the best of your knowledge.

dnaPower does not sell or rent personal information, biological samples, test-related information, or test results. Collection, use, storage, disclosure, retention, and protection of information and samples are governed by the dnaPower Privacy Policy.

4.  Sample Collection and Processing

You are responsible for following all sample-collection and return instructions provided with your testing kit. A sample may be unsuitable for testing because of insufficient quantity, contamination, damage, collection error, or another laboratory-quality issue.

If a sample is unsuitable, dnaPower may request a replacement sample or may be unable to complete testing. Sample handling, laboratory processing, retention, privacy protections, and destruction are addressed in the Privacy Policy.

5.  Accounts and Customer Portal

Certain Services require a customer account. You agree to provide accurate and complete account information and are responsible for keeping your login credentials confidential and secure.

You are responsible for activity that occurs through your account. Please notify dnaPower promptly if you suspect unauthorized access or use. dnaPower is not responsible for loss or misuse resulting from a customer’s failure to safeguard account credentials, except where liability cannot legally be excluded.

6.  Purchases, Prices, and Payment

Prices are shown in the applicable currency and may change without notice. Payment must be received in full before products are shipped or Services are provided. By placing an order, you confirm that you are authorized to use the selected payment method and agree to pay all applicable charges, taxes, and shipping fees.

dnaPower may refuse, cancel, or limit an order where reasonably necessary, including because of pricing errors, product availability, suspected fraud, payment-processing concerns, or inability to provide the requested service. Promotional pricing cannot be applied retroactively unless dnaPower expressly agrees otherwise.

7.  Shipping and Delivery

You are responsible for providing a complete and accurate shipping address. dnaPower is not responsible for delays, losses, returned shipments, rejected deliveries, or additional costs caused by incorrect, incomplete, or undeliverable information supplied by the customer.

If an order must be reshipped because of a customer-provided address error, additional shipping charges may apply.

8.  Returns, Refunds, and Cancellations

Except where required by applicable law, purchases are final and non-refundable once a testing kit has been sent, used, activated, registered, or returned to the laboratory.

Nothing in these Terms limits cancellation, return, refund, warranty, or other consumer rights that cannot legally be excluded. dnaPower may make exceptions at its discretion. Additional details are provided in the Return and Refund Policy.

9.  Privacy and Confidentiality

dnaPower is committed to protecting customer privacy. Personal information, samples, test-related information, and reports are collected, used, shared, stored, retained, and protected in accordance with the Privacy Policy.

You may request or authorize dnaPower to share a report with a practitioner, partner, consultant, or other person. dnaPower will provide access only with appropriate authorization or where disclosure is otherwise permitted or required by law.

10.  Scientific and Testing Limitations

Testing and reports have limitations. Not all genetic variations, microbiome factors, biological markers, medication-response factors, or other possible contributors to health or wellness are tested or reported. Results may be incomplete, may change in interpretation as scientific knowledge evolves, and may not be clinically validated for every purpose.

Results can be affected by sample quality, sample collection, laboratory processes, available scientific evidence, and the limitations of the particular testing method used. dnaPower is not required to update previously issued reports as scientific research, interpretation, or testing methods change over time.

11.  Medical and Wellness Disclaimer

dnaPower testing services, reports, website content, and related materials are provided for informational, educational, and wellness purposes only. They are not medical advice and are not intended to diagnose, treat, cure, prevent, or manage any disease or medical condition.

dnaPower does not practice medicine, provide medical diagnosis, prescribe treatment, or replace a qualified healthcare professional. You should not use a report as the sole basis for starting, stopping, delaying, or changing medication, treatment, medical care, or other significant health decisions. Always consult an appropriately qualified healthcare professional regarding medical concerns, symptoms, diagnoses, treatments, medications, or health-related decisions.

No guarantee is made regarding any particular health, wellness, nutrition, fitness, lifestyle, medication, or other outcome resulting from the use of dnaPower Services.

12.  Website Use

The dnaPower website is provided for lawful, personal, non-commercial use. You may not use the website in a manner that could damage, disable, overburden, impair, interfere with, or compromise the website, its security, or another person’s use of it.

You may not attempt to gain unauthorized access to accounts, systems, data, or restricted areas of the website or customer portal.

13.  Intellectual Property and Personal Use of Reports

Website content, reports, text, graphics, logos, trademarks, designs, methodologies, and other dnaPower materials are owned by or licensed to dnaPower and are protected by applicable intellectual-property laws.

Your personalized report is provided for your personal use. Except as permitted by law or with dnaPower’s prior written consent, you may not reproduce, publish, sell, distribute, modify, commercially exploit, or otherwise use dnaPower reports, content, or proprietary materials for commercial purposes.

14.  Third-Party Links and Services

The website may contain links to third-party websites or services. A link does not imply endorsement or approval. dnaPower is not responsible for the content, availability, accuracy, privacy practices, terms, products, or services of third parties. Your use of third-party services is subject to their own terms and policies.

15.  Disclaimer of Warranties

To the fullest extent permitted by law, dnaPower products, Services, reports, websites, portals, and related content are provided on an “as is” and “as available” basis. dnaPower makes no warranties or representations, express or implied, including warranties concerning accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or any particular result or outcome.

16.  Limitation of Liability

To the fullest extent permitted by law, dnaPower Inc., its affiliates, directors, officers, employees, consultants, laboratory partners, and agents are not liable for direct, indirect, incidental, special, consequential, exemplary, or other damages arising from or related to the purchase or use of dnaPower products, Services, reports, websites, or customer portal.

This includes damages relating to loss of data, lost profits, lost business opportunities, reliance on report information, or decisions made based on a report. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
